Terms and Conditions for Go2
These Terms and Conditions (“Agreement”) govern the use of the GO2 mobile application (the “App”), provided by GO2, its affiliates, and subsidiaries (collectively referred to as “Company,” “we,” or “us”). By accessing or using the App, you agree to comply with and be bound by this.
1. Acceptance of Terms
By using the App, you agree to the terms and conditions outlined in this Agreement. If you do not agree with any part of these terms, you must not use the App.
2. Definitions
• “User” refers to individuals who download or use the App to request on-demand services.
• “Service Provider” refers to individuals or businesses offering services through the App.
• “Services” refers to the on-demand services provided by Service Providers via the App.
• “App” refers to the mobile application provided by the Company for accessing the services.
3. User Account
To use the App, users may be required to create an account by providing personal information such as name, email address, phone number, and payment details. You agree to maintain the confidentiality of your account credentials and are responsible for all activities that occur under your account.
I hereby consent to Go2 processing my personal information, including credit information, for the purpose of assessing my details verification through a registered bureau. I understand that this may involve Go2 Pty Ltd sharing my information with the credit bureau and other credit providers for the purpose of credit assessment and. I acknowledge that I have the right to withdraw this consent at any time by contacting Go2 Pty Ltd via Email.
4. Service Availability
The App allows users to request on-demand services, which may include but are not limited to transportation, cleaning, delivery, repair, or other services. Availability of services may vary based on location and time, and the Company does not guarantee service availability at all times or in all locations.
5. Payment Terms
• Users will be charged for services based on the prices outlined in the App at the time of booking.
• Payments for services can be made through the payment methods available in the App.
• The Company reserves the right to modify service fees at any time, and users will be notified of such changes in advance.
6. Service Provider Responsibilities
Service Providers are independent contractors and are not employees of the Company. Service Providers agree to:
• Provide services in a professional manner.
• Comply with all applicable laws and regulations related to the services provided.
• Maintain any necessary licenses, insurance, and certifications as required by law or industry standards.
7. User Responsibilities
Users agree to:
• Use the App only for lawful purposes and in accordance with this Agreement.
• Provide accurate information when requesting services.
• Not engage in any fraudulent activity or abuse the services provided through the App.
8. User and Service Provider Ratings and Reviews
After services are completed, users may rate and provide feedback on Service Providers. Both users and Service Providers have the ability to provide ratings and reviews, and these ratings are based on their experiences.
9. Privacy and Data Protection
Your privacy is important to us. The Company’s Privacy Policy explains how we collect, use, and protect your personal data. By using the App, you consent to the collection and use of your data as described in the Privacy Policy.
10. Prohibited Conduct
Users agree not to engage in any of the following activities:
• Abuse, harass, or threaten any Service Provider or other users.
• Engage in any illegal activity while using the App.
• Attempt to manipulate or falsify ratings, reviews, or payment transactions.
• Interfere with or disrupt the functionality of the App.
11. Dispute Resolution
In the event of a dispute between users and Service Providers, or any other disputes related to this Agreement, the parties agree to first attempt to resolve the issue informally through communication. If the dispute cannot be resolved amicably, it will be subject to binding arbitration or mediation, as outlined in the Company’s dispute resolution policy.
12. Limitation of Liability
To the fullest extent permitted by law, the Company is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App or services provided by Service Providers. Users and Service Providers acknowledge that the Company is not responsible for the quality, safety, legality, or performance of the services.
13. Indemnification
Users agree to indemnify and hold harmless the Company, its officers, employees, and affiliates from any claim, demand, or damages, including legal fees, arising from their use of the App or violation of this Agreement.
14. Termination
The Company reserves the right to suspend or terminate user accounts for any reason, including but not limited to violation of these Terms and Conditions, fraud, or illegal activity. Users may terminate their account by following the procedure outlined in the App’s settings.
15. Modification of Terms
The Company reserves the right to modify these Terms and Conditions at any time. Users will be notified of any significant changes, and continued use of the App after such changes will constitute acceptance of the new Terms and Conditions.
16. Governing Law
This Agreement is governed by and construed in accordance with the laws of South Africa. Any disputes related to this Agreement will be subject to the exclusive jurisdiction of the courts in Cape Town.
